Heather Hardy Files Lawsuit Against Boxing Entities
On September 11, retired boxer Heather Hardy submitted a 62-page legal complaint in New York State Supreme Court. The suit names several defendants, including two of Hardy’s past promoters: Boxing Insider and DiBella Entertainment, along with their representatives. Everlast Worldwide, the combat sports equipment manufacturer used by Hardy, and Dr. Nitin Sethi, the medical director for the New York State Athletic Commission, are also included as defendants, along with unnamed “John Doe” defendants.
Health Concerns and Allegations
The complaint asserts that Hardy suffers from chronic traumatic encephalopathy (CTE) and frontal lobe damage, leading to daily seizures, impaired vision, and severe anxiety. It goes on to claim that the defendants are responsible for her deteriorating health conditions and alleges that the DiBella defendants violated equal pay laws by undercompensating her compared to her male counterparts.
Financial Inequities Highlighted
Hardy’s earnings from 25 fights in New York totaled $236,450, a stark contrast to the wealth generated for her promoters. The complaint highlights how Hardy contributed significantly to the boxing scene while only receiving a fraction in return, suggesting a gross discrepancy in compensation based on gender in the sport.
Disputed Fighting Career
Throughout her career, Hardy garnered respect for her determination in the ring, though her opponents were often strategically chosen. Notably, her loss to Amanda Serrano was framed as a brave effort against a skilled opponent, but post-fight challenges, including a failed drug test, complicated her legacy. The lawsuit also references her later fights, claiming they further harmed her health, although she was cleared to compete each time.
Legal Complications and Responsibilities
Hardy’s legal team argues that both the New York State Athletic Commission and the promoters have a shared responsibility for fighter safety. The lawsuit challenges existing contracts that negate promoter liability, asserting that Hardy was unsuitable to consent to those agreements due to her declining cognitive health at the time of signing.
Disgraceful Allegations Against Medical Professionals
The complaint accuses Dr. Nitin Sethi of neglect in providing adequate medical care. However, the statute of limitations could impede this claim since it exceeds the allowable period for medical malpractice in New York. The allegations also lack substantial evidence, casting doubt on their viability.
Impact on Future Support in Boxing
The lawsuit could deter future cooperation from various stakeholders in Hardy’s career, as her actions are seen as attacking those who previously supported her. The boxing community, including supporters and peers, raises concerns about the precedent this lawsuit may set, emphasizing Hardy’s responsibility in her own well-being.
