Disciplinary Actions Against ICC Chief Prosecutor
The Chief Prosecutor of the International Criminal Court (ICC), who has filed war crimes charges against Israel’s Prime Minister and former Defense Minister, is currently facing disciplinary proceedings due to accusations of sexual misconduct.
Investigation Leads to Proceedings
After an extensive year-long investigation into allegations that Karim Khan engaged in inappropriate conduct with a subordinate, the Bureau of the Assembly of States Parties (ASP) has decided to advance disciplinary actions against him, as reported by Reuters.
Serious Allegations Surface
According to The New York Times, the alleged victim disclosed her interactions with Khan to her spouse and colleagues in April 2024. In May, after being confronted by colleagues, Khan reportedly accepted an alternative narrative suggesting potential involvement from Mossad.
Political Context and Reactions
Shortly after these developments, Khan issued arrest warrants against Prime Minister Benyamin Netanyahu and former Defense Minister Yoav Gallant. In February 2025, Khan faced sanctions from the Trump administration in response to these warrants.
Concerns Over Integrity of the Process
Eugene Kontorovich from George Mason University criticized Khan, suggesting that pointing fingers at Mossad indicates a compromised position. He expressed that the politicized nature of the investigation undermines the integrity of the ICC.
Disciplinary Vote and Judicial Findings
The ASP voted to pursue disciplinary action against Khan with 15 votes in favor, four against, and two abstentions. This decision contrasts with the previous ruling by three judges who found insufficient proof to support the allegations against him.
Broader Implications for ICC
The Association of International Criminal Law Prosecutors (AICLP) indicated that “structural deficiencies” within the ICC were evident during this process. They emphasized that a transparent resolution is essential for restoring the operational integrity of the institution.
